Terms of service
PART I — COMMON TERMS
1. Seller. Products are sold by EKO ONLINE BUSINESS LLC, a company formed in New Mexico (United States), registration 0008088013, address 4405 JAGER DR NE, STE C4-4054, RIO RANCHO, NM 87144, USA, contact +1 505 393 7120. EKO Industrials is a brand of EKO ONLINE BUSINESS LLC; it is not a separate entity.
2. Scope. These Terms apply to downloadable digital products sold under the EKO Industrials brand by EKO ONLINE BUSINESS LLC through the EKO Industrials Shopify store (Schedule A). They do not apply to services. Part II applies if you are a consumer; Part III if you buy in the course of a business. The refund policy forms part of these Terms.
3. Formation of the contract. The contract is concluded when, before proceeding to payment, you tick on the cart page the unticked box by which you accept these Terms and the refund policy, which you can read before payment, and then complete payment.
4. Rights granted and prohibited uses. Your purchase gives you a right to use the product within the scope set out in Schedule A; it transfers no ownership. Intellectual property remains with EKO or the applicable rights holders. Unless separately licensed, the following are prohibited for every product: resale; redistribution; sublicensing; making the product publicly available; sharing with people the purchase does not cover; removing EKO's notices; commercially exploiting the product as material or a deliverable supplied to third parties.
5. Price and payment. The price payable is the one displayed when you order, in the currency displayed. Payment is due on ordering and processed by the store's payment provider. EKO does not store card details.
6. Delivery and access. After payment the product is made available for download. You hold a permanent right to the version you bought. Each purchase allows 10 downloads and the link does not expire. Support can restore legitimate access to the same product. The purchase does not include future major versions, other products or new editions.
7. Refunds. Refunds and cancellations are governed by the refund policy.
8. Warranties and liability. 8.1 EKO warrants no commercial, operational, financial or learning result, issues no certification or qualification, and does not warrant the buyer's compliance with any standard or regulation. 8.2 Nothing in these Terms excludes or limits: a right or warranty that applicable law does not allow to be excluded or limited; mandatory consumer rights, including as to conformity, refund, withdrawal, remedies and forum; liability for fraud or wilful misconduct; any liability that law forbids limiting. This clause 8.2 prevails over anything to the contrary.
9. Support and complaints. Requests and complaints are made in writing to secretariat@ekoonlinebusiness.com, with the order reference. EKO aims to reply within 2 working days. EKO imposes no arbitration for consumer purchases.
10. Personal data. Data needed for the order is processed in accordance with the store's privacy policy.
11. Breach. In the event of a serious breach, in particular of clause 4, EKO may, after notice and, where appropriate, a period to remedy it, end your right to use the product; you then stop using it and delete the copies where lawful and practicable. Provisions on payment, intellectual property, liability and disputes survive.
12. Governing law and jurisdiction. 12.1 Business customers: the law of the State of New Mexico (United States); the state or federal courts of New Mexico. 12.2 Consumers: the law of the State of New Mexico (United States). That choice does not deprive you of the protection of the mandatory provisions of the law applicable to you, or of the mandatory forum you are entitled to. 12.3 Cameroon's mandatory rules, including on electronic commerce, consumer protection and personal data, apply where the conditions for their application are met. 12.4 For a purchase on a third-party platform, the platform's terms govern the relationship between the platform and you to the extent they provide; these Terms apply to the extent EKO is the seller and the platform permits.
13. Applicable version. The version of these Terms and of the refund policy applicable to your order is the one in force on the date of the order. Version 1.0 — effective 2026-09-17.
PART II — CONSUMER OVERLAY
C.1 Your statutory rights prevail. Nothing in the contract or the refund policy limits a right that law does not allow to be limited: conformity, refund, withdrawal, remedies, forum. This clause prevails over anything to the contrary.
C.2 Digital content — consent before download. A digital product is delivered immediately and a download cannot be undone. Where applicable law provides for it, EKO obtains before download, on the cart page and through a separate unticked box, your express request for immediate supply and your acknowledgement of the resulting loss of the right of withdrawal. Without that consent, the right of withdrawal subsists as applicable law provides. Remedies for non-conformity remain in every case.
C.3 Before purchase. Before purchase, EKO makes available the seller's identity, the product description, the price payable, delivery, the refund policy, the complaints procedure and the privacy policy.
C.4 No business cap. The limits in Part III do not apply to consumers.
PART III — BUSINESS OVERLAY
B.1 Where you buy in the course of a business, and to the extent applicable law permits: implied warranties are disclaimed; EKO is not liable for indirect or consequential loss, including loss of profit, business, data or opportunity; EKO's aggregate liability in respect of a product is capped at the amount actually paid for that product. B.2 These limits do not apply to anything in clause 8.2.
